Overtime and Minimum Wage Violations

Oregon law requires most employees to be paid time and a half for all hours worked over 40 in a workweek. The state also uses a tiered minimum wage system based on region, with rates that increase regularly and rank among the highest in the nation. If your employer failed to pay proper overtime or minimum wage, you may be entitled to recover unpaid wages and penalties.  

Meal and Rest Break Violations

Oregon law requires a 30-minute unpaid meal break for shifts of 6 hours or more, typically taken between the second and fifth hour of work. Employees are also entitled to paid 10-minute rest breaks for every 4 hours worked (or major portion thereof). These breaks must be uninterrupted. If you were forced to skip breaks or work through them, you may have a claim. 

Employee Misclassification

Many Oregon workers are improperly classified as “exempt” employees or independent contractors. This allows employers to avoid paying overtime, benefits, and payroll taxes. If you’ve been misclassified, you may be owed significant back pay and other compensation.
