Crosner Legal Files Class Action Lawsuit Against Sun Bum for False Advertising

The lawsuit, filed in the Superior Court of California, asserts that Sun Bum misled consumers by marketing its “Face” sunscreen as a product specially formulated for facial skin when it is nearly identical to Sun Bum’s regular sunscreen, except for the removal of fragrance.

Consumers purchase facial sunscreens with the expectation that they are designed with unique ingredients or benefits tailored to delicate facial skin. Sun Bum reinforces this perception by prominently labeling the product as “Face” sunscreen and charging a premium price compared to its regular body sunscreen. However, the lawsuit alleges that both versions contain the same active ingredients in identical concentrations, meaning Sun Bum’s marketing misleads consumers into believing they are purchasing a specialized facial product when they are not.

California law prohibits deceptive advertising and unfair competition, including misrepresenting product attributes or charging a premium for misleading claims.
