Crosner Legal has taken significant legal action to protect consumer privacy by filing two separate class action lawsuits in California federal court. These lawsuits target data brokers that operate sophisticated “sales prospecting” and “people search” websites, which we allege are in violation of state-level consumer protection laws.
The complaints allege that both companies operate as data aggregators, compiling massive online directories of personal information. This data, including job history, email addresses, and private mobile phone numbers, is then sold to subscribers for commercial purposes, such as B2B sales and marketing. Our lawsuits allege that these companies knowingly list the private cellular telephone numbers of Colorado residents in their directories without ever obtaining the “affirmative consent” required by law.
This alleged practice is a direct violation of Colorado’s Prevention of Telemarketing Fraud Act (PTFA). The Colorado legislature enacted this law specifically to address the “widespread practice of fraudulent and deceptive commercial telephone solicitation” and to protect individuals from the unauthorized commercial listing of their cell phone numbers.
