Crosner Legal Expands to Illinois and Files First Major GIPA Class Action

Crosner Legal is thrilled to announce a major expansion of our firm’s practice with the opening of our new office in Chicago, Illinois. This new office allows us to bring our dedicated fight for employee and consumer rights to the Midwest, and we are hitting the ground running.

Welcoming Adam York to the Team

Leading our new Chicago office is Partner Adam C. York. Adam is a highly skilled litigator licensed to practice in Illinois who shares our firm’s passion for holding companies accountable and protecting the rights of individuals.

Adam brings nearly two decades of experience in complex litigation on behalf of both consumers and businesses. Before attending law school, he worked as a software developer, and he leverages that technical experience to hone his expertise at the intersection of technology and privacy regulations.

Adam’s practice focuses on representing consumers in class-action cases involving privacy, technology, consumer fraud, and false advertising. He earned his Bachelor of Science from Stanford University and his Juris Doctor from the Chicago-Kent College of Law, where he was a member of the Moot Court Honor Society and wrote for the Seventh Circuit Review.

Our First Case in Illinois: A GIPA Class Action

Demonstrating our immediate commitment to protecting the rights of Illinois residents, our new team has already filed its first significant class action lawsuit in the Circuit Court of Cook County.

The lawsuit is a class action filed against a major freight transportation and logistics company for alleged violations of the Illinois Genetic Information Privacy Act (GIPA).

The complaint alleges that the company maintained an unlawful practice of requiring job applicants to disclose their genetic information as a condition of employment. It is alleged that during a mandatory, pre-employment medical examination, applicants were required to fill out a questionnaire and answer questions about their family medical history—specifically, whether their family members had a history of inheritable conditions like heart disease, high blood pressure, diabetes, or cancer.

GIPA explicitly defines “genetic information” to include an individual’s family medical history. The law broadly prohibits any employer from directly or indirectly soliciting, requesting, or requiring such information as a condition of employment.

Our lawsuit seeks to stop this alleged unlawful practice and recover statutory damages for every individual who was subjected to these improper inquiries.
