Crosner Legal is currently investigating a large retail corporation for potential privacy rights violations involving the unlawful use of facial recognition technology in the City of Portland, Oregon.
Our ongoing investigation focuses on allegations that this major retailer uses facial-recognition-enabled cameras at its self-checkout kiosks and throughout its store locations as part of a loss-prevention and “computer vision” program. These systems allegedly capture, scan, analyze, or process the facial geometry and facial characteristics of customers. Crucially, this biometric data collection is allegedly occurring without customer notice, consent, or any legally valid justification.
This practice raises serious concerns under Portland City Code Chapter 34.10. Under Portland City Code § 34.10.030, “private entities” are categorically prohibited from using “Face Recognition Technologies” within “Places of Public Accommodation”. The ordinance strictly defines these technologies as automated or semi-automated processes that assist in identifying, verifying, detecting, or characterizing an individual’s facial features, or capturing information based on their face.
The law provides strict penalties for these privacy breaches. Under Section 34.10.050(A), any person injured by a material violation is entitled to recover the damages they sustained as a result of the violation or $1,000 per day for each day of the violation, whichever is greater.
