The lawsuit challenges the sale of Diaper Rash Ointment, which is prominently labeled as “Hypoallergenic” despite containing lanolin—a substance widely recognized as a common allergen among infants and young children.
According to the complaint, lanolin was named “Contact Allergen of the Year” by the American Contact Dermatitis Society in 2023. Medical studies recommend against using lanolin on children under two and on damaged skin, such as diaper rash, because it can increase the likelihood of allergic reactions, including allergic contact dermatitis. Symptoms may include redness, itching, blistering, and swelling. The lawsuit further notes that the ointment also contains sorbitan sesquioleate, an emerging contact allergen, further undermining its “hypoallergenic” claim.
The lawsuit asserts that the “Hypoallergenic” label misleads parents into believing the product is specially formulated to minimize allergic reactions, when in fact it contains ingredients known to trigger them. California consumers, the complaint alleges, paid a premium for what they believed to be a safer, gentler baby care product. By advertising the ointment as hypoallergenic, the retailer allegedly violated California’s Consumers Legal Remedies Act, Unfair Competition Law, and breached express warranties.
The case seeks injunctive relief to stop the company from continuing to label the product as hypoallergenic, restitution for consumers who purchased the ointment, and corrective disclosures to ensure accurate labeling in the future.
