Crosner Legal has filed a class action lawsuit against a national snack food manufacturer, challenging the company’s advertising and labeling of its nut products. The lawsuit, filed in the United States District Court for the Central District of California, alleges that the company misleads consumers by prominently claiming its products contain “No Artificial Flavors, Preservatives, or Synthetic Colors” when, in fact, the products are made with manufactured citric acid—an artificial preservative.
According to the complaint, the use of manufactured citric acid is inconsistent with the company’s “No Artificial Preservatives” labeling. Manufactured citric acid is created through chemical processing involving black mold and industrial solvents, and has long been recognized by regulatory agencies and scientific studies as synthetic in nature. The lawsuit argues that the presence of this ingredient renders the products artificially preserved, contrary to the marketing representations made to consumers.
The action brings claims under California’s Consumers Legal Remedies Act and Unfair Competition Law, as well as for breach of express warranty. It seeks to stop the company from continuing its allegedly deceptive marketing practices and to obtain restitution for consumers who purchased the mislabeled products.
Crosner Legal contends that consumers increasingly rely on “free-from” labeling, such as preservative-free claims, when making purchasing decisions. Surveys and market data show that a significant portion of consumers view “preservative-free” foods as healthier and are willing to pay a premium for them. By advertising its snack products as preservative-free while using artificial preservatives, the company allegedly gained an unfair competitive advantage over brands that accurately disclose their ingredients.
The lawsuit seeks injunctive relief, corrective advertising, and restitution on behalf of consumers who purchased the products while believing they contained no artificial preservatives.
