CL Obtains Final Court Approval for $2.8 M Wage & Hour Class Action Settlement Against Mercury Insurance

Crosner Legal is pleased to announce that the Los Angeles County Superior Court has granted final approval to a $2.8 million class action settlement on behalf of non-exempt employees of Mercury Insurance Services, LLC. The settlement resolves claims that the insurance company violated numerous California labor laws. The Court’s final approval order was entered on August 19, 2025. Crosner Legal, alongside co-counsel at James Hawkins APLC and GrahamHollis APC, represented the plaintiffs in this hard-fought litigation.

The settlement resolves three separate lawsuits that were consolidated into a single action, including a putative class action filed by Crosner Legal’s client, Andrew Dat, on August 4, 2022. The lawsuits alleged that Mercury Insurance engaged in a series of unlawful employment practices affecting its California-based, non-exempt employees. The core allegations included claims for:

  • Failure to pay minimum and overtime wages
  • Failure to provide legally compliant meal and rest periods
  • Failure to provide accurate itemized wage statements
  • Failure to timely pay all wages owed upon separation of employment
  • Failure to reimburse necessary business expenses

The settlement was reached after extensive investigation, substantial exchanges of documents, and a full-day mediation session. Under the terms approved by the Court, Mercury will pay a Gross Settlement Amount of $2,800,000 to resolve the claims.

The settlement is non-reversionary, meaning all net funds will be distributed to employees, and no money will return to Mercury. Eligible employees will receive their settlement payments automatically without the need to submit a claim form.

The response from the class members was overwhelmingly positive. Out of 3,838 notices sent to class members, there were zero objections to the settlement and only five requests for exclusion, resulting in a 99.8% participation rate.

On August 19, 2025, the Honorable Carolyn B. Kuhl of the Los Angeles County Superior Court granted the Motion for Final Approval.
