The California Labor Board, formerly known as the Division of Labor Standards Enforcement (“DLSE”), is a California agency which has been mandated with the goal of investigating into and rendering decisions regarding unpaid wage claims and retaliation claims.
There are two divisions of the Labor Commissioner which each handle different types of claims. Claims brought by individual employees are handled by the Labor Board’s Wage Claims Offices, while claims that affect many workers at once are investigated into by the Bureau of Field Enforcement.
The Labor Board’s Wage Claims Offices receive complaints filed by employees (or their representatives) and attempt to resolve them through an informal hearing and then a formal hearing (if the informal hearing is unsuccessful).
The first step to filing a complaint is to know which Wage Claims Office it should be filed with. The proper office to file your Labor Board Complaint with the Wage Claim Office closest to either your residence or the location of where you worked (i.e. your employer’s address) – the reason is because this is the location where the injury occurred. However, if you file your claim with the incorrect office, that office will generally forward your Complaint to the proper local Wage Claim Office. The downside of filing in the wrong office is that it will likely take at least a few weeks, if not months, longer for your complaint to be processed by the proper local Wage Claim Office.
