Under California law, security guards must be paid one additional hour of pay in every shift where they are required to either (1) monitor their cell phones, walkie talkies or other dispatch device during their meal break, or (2) must remain on the premises during their meal break. This is called an “on-duty” meal break
In addition, they must be paid another one hour of pay for an “on-duty” rest break.
This means that in any given day, a security guard is likely owed two additional hours of pay – i.e. if you work an 8-hour shift, you should actually be paid for 10 hours. In our experience, this almost never happens.
