Erika Lane

Erika is a partner at Crosner Legal in Seattle, Washington. She practices in complex litigation, including the prosecution of wage and hour, civil rights, and consumer class actions, as well as individual discrimination and disability rights cases, and cases on behalf of victims of sexual abuse. She has served as lead and co-lead counsel in successful state, multi-state, and nationwide class actions in both state and federal court and argued successfully at the Washington Court of Appeals and the Ninth Circuit.

Erika has secured victories for her clients both in and out of the courtroom, including:

  • Settled multi-million-dollar pre-litigation settlement for claims of outrage and accommodation and leave violations against a multinational technology company.
  • Negotiated $2.1 million settlement on behalf of Washington workers who alleged missed rest and meal breaks, time editing, and failure to properly pay overtime by their employer. Sycks v. Incyte Pathology, Inc., Spokane County Superior Court.
  • A five-week wage and hour class action trial resulting in a $4.1 million jury verdict for approximately 300 drywall workers, upheld on appeal. Ramirez v. Precision Drywall, Inc. et al., 164 Wn. App. 1032 (fka Erika L. Nusser).
  • Certified wage and hour claims on behalf of class of truck drivers, defeated employer’s motions for summary judgment and to decertify, obtained summary judgment establishing employer’s liability for unpaid rest breaks, and negotiated settlement with Judge Lasnik commenting on the quality of the work performed as being “of the highest caliber.” Helde v. Knight Transportation, Inc., W.D. Wash.
  • Defeated motions to compel arbitration and successfully argued appeals of the same before the Washington State Court of Appeals and the Ninth Circuit Court of Appeals. Friel v. Legal Helpers Debt Resolution, Washington Court of Appeals Division 1 (argued April 18, 2014); Smith v. JEM Group, Inc., 737 F.3d 636 (9th Cir. 2013).

She also coauthored the chapter on discovery in the National Consumer Law Center’s Class Action manual, co-edited and wrote several chapters of the Consumer Protection Deskbook published by the Washington State Association for Justice, and has been repeatedly named to the annual Rising Star List (2013–2021) and Super Lawyers List (2022–2023) by Washington Super Lawyers.
