Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy explains how Crosner Legal, P.C. collects, uses and shares “consumer health data” as defined in the Washington My Health My Data Act (RCW 19.373), and the rights of Washington residents and of people whose consumer health data is collected in Washington. It supplements our Privacy Policy.

What consumer health data we collect. We are a law firm. We do not operate health services, sell health products, or track your health. In the course of evaluating an employment, discrimination, harassment, retaliation, or consumer claim, you may choose to tell us about: a physical or mental health condition, diagnosis or treatment; a disability or accommodation request; medical, family or pregnancy-related leave; reproductive or sexual health; gender-affirming care; or medications, injuries or health-related absences. We may also receive this information in documents you send us (medical notes, leave requests, HR correspondence) or from a referring attorney with your knowledge. We do not collect precise geolocation data to infer health status, and we do not use biometric data.

Why we collect it. Solely to evaluate the legal claim you have asked us to assess, to run conflict checks, and, if you become a client, to represent you. We do not use consumer health data for advertising or marketing, and our advertising partners do not receive it. We will not collect additional categories of consumer health data, or use it for additional purposes, without first revising this policy and obtaining your affirmative consent.

Sources. You; documents you provide; referring or co-counsel attorneys; and, if you become a client, your employer, opposing parties and third parties through the litigation process.

How we share it. Only with firm attorneys and staff working on your inquiry; co-counsel or referral attorneys, with your knowledge; service providers under contract (case-management, document storage, communications and e-signature vendors) who may use it only to provide services to us; and as required by law, court order, or the rules governing lawyers. We do not sell consumer health data, and we will not do so without obtaining the separate written authorization that RCW 19.373.070 requires.

Your rights. You may (1) confirm whether we are collecting, sharing or selling your consumer health data and access it, including a list of third parties and affiliates with whom we have shared it; (2) withdraw consent to our collection or sharing of it; and (3) request that we delete it, including from our service providers and backups where technically feasible. We may decline to delete data we are required to keep by law, court rule or the Rules of Professional Conduct, and will explain why. To exercise these rights, email help@crosnerlegal.com, call 1-866-CROSNER, or write to the address in our Privacy Policy. We will verify your identity and respond within 45 days, extendable once by 45 days where reasonably necessary. If we deny your request, you may appeal by replying to our response or emailing help@crosnerlegal.com with “Appeal” in the subject line; we will respond within 45 days. If your appeal is denied, you may contact the Washington Attorney General at atg.wa.gov.

Changes. We will post any revised version on this page with a new effective date.
