Kyle McLean obtained his J.D. in 2019 from the University of California, Hastings College of the Law, with an emphasis in Civil Litigation. He was selected to participate in the Hastings Appellate Program, where he was one of only two students chosen to represent a pro bono client before the Ninth Circuit Court of Appeals and deliver oral and written argument before the Court. He received his B.A. in History and Economics from California Polytechnic University, Pomona in 2015.
Mr. McLean has served as lead and class counsel in precedent-setting privacy litigation and has played a significant role in the development of the Illinois Genetic Information Privacy Act (“GIPA”). In 2023, Mr. McLean filed the first lawsuit in the nation alleging violations of Section 25(c)(1) of GIPA arising from an employer’s request for genetic information. Since then, Mr. McLean has been appointed as Lead Class Counsel in multiple GIPA actions.
He served as counsel in numerous data privacy and consumer protection matters, including: Page v. Ford Motor Co. (Cir. Ct. Sangamon Cty.) (first class-wide settlement of GIPA claim; final approval granted for $17,500,000 settlement involving over 10,000 class members); King v. Lightricks, US Inc. (Cir. Ct. Sangamon Cty.) ($4,485,000 class settlement for Illinois Biometric Information Privacy Act claims); and Carter v. Vivendi Ticketing US LLC (C.D. Cal.) ($3,000,000 class settlement concerning a data breach).
