Crosner Legal has filed a class action lawsuit against BYLT, LLC in King County Superior Court, alleging violations of Washington’s Commercial Electronic Mail Act (CEMA) and the Washington Consumer Protection Act (CPA). The complaint asserts that BYLT engaged in deceptive commercial email practices by disseminating promotional messages with misleading subject lines to consumers located in Washington State.
Specifically, the lawsuit challenges BYLT’s repeated use of subject lines such as “ENDS TODAY” and “Final Hours” to convey a sense of urgency and finality concerning promotional sales. In reality, however, these same promotions were routinely extended beyond the deadlines represented in the subject lines, often with follow-up emails offering identical or nearly identical discounts the very next day. The body of these emails frequently contradicted the subject line by including ambiguous language such as “while the promotion lasts,” thereby revealing that the urgency conveyed in the subject line was misleading and materially inaccurate.
Washington’s CEMA prohibits the transmission of commercial email messages containing false or misleading information in the subject line. A violation of CEMA constitutes a per se violation of the Consumer Protection Act, which is designed to safeguard the public from unfair and deceptive business practices. The complaint alleges that BYLT knowingly targeted Washington consumers through these deceptive marketing tactics and that the company had access to sufficient data, including shipping addresses, billing information, and website activity associated with Washington-based IP addresses to be aware that its conduct affected Washington residents.
The lawsuit seeks statutory damages of $500 per violation, as well as injunctive relief prohibiting BYLT from continuing to distribute commercial email messages that contain false or misleading subject lines. Such practices not only violate statutory protections but also compromise the integrity of consumer decision-making by manipulating recipients through fabricated time constraints and urgency.
