Crosner Legal Challenges Kroger’s Claims on Artificial Preservatives in Pet Food

Crosner Legal has filed a class action lawsuit against The Kroger Co., alleging that the company falsely markets certain Abound® brand dog food products as containing “No Artificial Colors, Flavors or Preservatives,” in violation of California’s consumer protection laws. Filed in the United States District Court for the Central District of California, the complaint challenges Kroger’s labeling practices on several Abound® Wild Beginnings All Life Stages Dry Dog Food varieties that list citric acid among their ingredients; an additive widely recognized in the pet food industry as a synthetic preservative.

The complaint asserts that citric acid is not added for nutritional value or flavor, but rather to preserve freshness and extend shelf life—functions that qualify it as a preservative under federal and California regulations. Despite this, the products are prominently labeled as free of artificial preservatives, allegedly misleading consumers who rely on such representations when selecting products for their pets.

The lawsuit identifies at least three products at issue:

  1. Abound® Wild Beginnings All Life Stages Dry Dog Food Beef, Venison & Lamb
  2. Abound® Wild Beginnings All Life Stages Dry Dog Food Chicken, Turkey & Duck
  3. Abound® Wild Beginnings All Life Stages Dry Dog Food Salmon, Trout & Whitefish

These products are sold through Kroger’s extensive retail and online operations and are marketed to pet owners seeking food options free from artificial additives. The complaint contends that Kroger’s labeling and advertising create a false impression about the ingredients and benefits of its Abound® products, thereby violating California’s Consumers Legal Remedies Act, False Advertising Law, and Unfair Competition Law.

The lawsuit seeks injunctive relief to stop Kroger from continuing these deceptive labeling practices, as well as restitution and other remedies on behalf of California consumers who purchased the affected products under the mistaken belief that they were free from synthetic preservatives.
