Crosner Legal Files Class Action Lawsuit Against Samsung For Deceptive Marketing Practices

Crosner Legal has filed a class action lawsuit against Samsung Electronics America, Inc., alleging violations of Washington’s Telephone Buyers’ Protection Act (TBPA) and Consumer Protection Act (CPA). The lawsuit, filed in King County Superior Court, accuses Samsung of failing to disclose critical information about its Galaxy phones at the point of sale, including who is responsible for repairs, the standard repair charges, and the terms of the warranty as expressly required under Washington law.

Under the TBPA, sellers of telecommunications equipment must clearly disclose certain material facts prior to sale, either on the packaging or by posting a notice where the products are sold. The lawsuit asserts that Samsung’s Galaxy phone packaging omits these legally mandated disclosures, and that Samsung also fails to post this information at retail stores. Consumers purchasing Galaxy phones are left unaware of potentially significant repair costs or important warranty limitations until after completing their purchase, despite state law requiring full transparency up front.

This lack of disclosure is not trivial. Standard repair costs for Galaxy phones can range from $99 to over $250 for issues like cracked screens, depending on the model. Yet this information is buried on Samsung’s website instead of being clearly presented at the time and place of purchase, where consumers would reasonably expect to evaluate it before deciding to buy. Similarly, Samsung’s limited warranty terms are available online, but are not disclosed on the product’s packaging as required. Washington law deems violations of the TBPA to be per se violations of the CPA, underscoring the seriousness of Samsung’s omissions.

The lawsuit seeks declaratory and injunctive relief, aiming to force Samsung to comply with Washington’s consumer protection laws by ensuring that future sales of Galaxy phones include proper disclosures. Consumers have a right to receive clear, complete, and truthful information about major purchases without being forced to search through corporate websites after the fact. Honest marketing and full transparency are not optional — they are legal obligations intended to protect buyers from hidden risks and unfair surprise costs.
