Crosner Legal Files Class Action Lawsuit Against Whole Foods for False Advertising

Mar 21, 2025 | Class Actions, Consumer Protection

Crosner Legal has initiated a class action lawsuit against Whole Foods Market, Inc., alleging deceptive and misleading marketing practices related to its 365 Whole Foods Market branded baking soda. Filed in the Superior Court of California, the lawsuit contends that Whole Foods misrepresented its product by labeling it as “Non-GMO”; despite the fact that genetically modified baking soda does not exist.

The complaint asserts that Whole Foods strategically employs the “Non-GMO” label as a marketing device to create a false perception of superiority over competing products. Sodium bicarbonate, the sole ingredient in baking soda, is a simple chemical compound that contains no DNA and, therefore, cannot be genetically modified. Nevertheless, Whole Foods prominently advertises its baking soda as “Non-GMO,” thereby misleading consumers into believing they are purchasing a product with distinctive or enhanced attributes.

Consumer protection laws prohibit not only outright false advertising but also marketing strategies that mislead, deceive, or create unfounded perceptions. The lawsuit highlights that consumers often associate “Non-GMO” labels with higher quality and health benefits, and companies frequently capitalize on this assumption to justify premium pricing; even when the claim itself is scientifically meaningless.

The class action seeks to hold Whole Foods accountable for false advertising and unfair competition under California law. It demands restitution for affected consumers and injunctive relief to prevent Whole Foods from continuing these deceptive labeling practices.

Consumers have a fundamental right to honest and transparent labeling. They should not have to question whether marketing claims are legitimate or merely manipulative sales tactics. Crosner Legal remains steadfast in its commitment to protecting consumer rights and ensuring corporate accountability.
