We are excited to announce that Crosner Legal, in partnership with Clarkson Law, has achieved a significant appellate victory in our false labeling class action lawsuit against Huggies. The lawsuit challenges the misleading product labels on Huggies’ baby wipes, which claim the products are natural and plant-based. This appellate decision is a crucial step forward in holding companies accountable for deceptive marketing practices.
The class action lawsuit was filed by plaintiffs who alleged that Huggies falsely labeled their baby wipes as “natural” and “plant-based” without appropriate disclaimers on the front of the packaging. It is alleged that these labels misled consumers into believing the products were free from synthetic and chemical ingredients, which was not the case.
On June 19, 2024, the Court of Appeal issued its ruling on the defendants’ motion to dismiss. The court ruled that the claims regarding Huggies’ product labels, which lacked front-of-package disclaimers, should not be dismissed. This decision was based on several key factors:
- Consumer Deception: The court found that the lack of disclaimers on the front of the packaging could reasonably mislead consumers. The court highlighted that consumers often make purchasing decisions based on front-of-package representations and may not read the entire packaging to find disclaimers.
- Material Misrepresentation: The court emphasized that the representations of the baby wipes being “natural” and “plant-based” were material to consumers’ purchasing decisions. The absence of clear disclaimers on the front packaging could lead consumers to believe that the products were entirely free of synthetic substances, which constituted a deceptive practice.
- Legal Precedent: The court distinguished this case from the McGinnity decision, where the court found that sufficient disclaimers were present to inform consumers adequately. In the Huggies case, the appellate court noted the absence of such disclaimers on the front packaging, making the representations misleading and actionable.
