Crosner Legal is pleased to announce the settlement of a class action and PAGA representative action lawsuit against Renal Treatment Centers, Inc., a subsidiary of DaVita Inc., for $7.5 million. This settlement aims to compensate all non-exempt employees of the company and certain subsidiaries for alleged labor violations. The settlement was reached by CL, along with co-counsel, in March 2024 and is currently awaiting preliminary approval.
The lawsuit, initiated by plaintiff Jennifer Thornton, was filed on behalf of all non-exempt employees who worked at any of the dialysis facilities in California. The complaint alleged that the company failed to comply with various labor laws, including not providing proper meal and rest breaks, not furnishing accurate itemized wage statements, and not reimbursing business expenses. The lawsuit claimed that the defendants uniformly applied these unlawful policies and practices across all their California locations, thereby impacting all non-exempt employees in the state.
Key allegations in the complaint included:
- Underpayment of wages, including minimum and overtime wages.
- Failure to provide legally mandated meal and rest periods or premium payments in lieu thereof.
- Issuance of inaccurate itemized wage statements.
- Failure to reimburse employees for necessary business expenses.
- Not paying all wages due upon separation of employment.
- Engaging in unfair competition in violation of California Business and Professions Code sections 17200, et seq.
The settlement funds will be distributed among all eligible class members, ensuring they receive compensation for the alleged labor violations they experienced.
